I. Why inquest and how invest

1 Why and how authorized him to inquest
  Through the court proceeding, it should be started to have trial meetings first.
But it may concern to have a system or rules based on minor's situations and minds to have meetings with their mother go smoothly thus it had troubles their mother as petitioner refused to bring back minors to opponent and the new life which opponent remarried then spouse's children of his new wife are living together now has started.

And we have to invest petitioner to judge to enforce meetings or not, also petitioner could handle the situation or understand after it revealed minor's situation and their minds.
So before the trial meetings court decided to have a preparation investigation.

 

2 Background of inquest

1. It became apparent that Petitioner minds to sue the change of parental right depends on taking-over minors is the highest require of petitioner was the conclusion in the inquest conducted on 22 Oct 2013.

2. About inquest on minors, handed attachment 1 to opponent and explained why and how the inquest needed. explained to minors with attachment 2. Opponent dithered how to explain about this inquest considering new wife's children' feelings. Inquisitor told opponent should explain to children of step-mother because secret would be burden on minors.
    Inquisitor dismissed petitioner's requires submitted by writing on 2 Dec 2011which was request inquisitor to read letter of petitioner wrote for minors mind to have inquest or to admire petitioner before the inquest because the inquest stands on neutral and needs to grab the natural situation of minors to explain procedure related on minors’ growth.

 

 

II. Conclusion of inquest of petitioner.

Below 1 and 2 are from statement by petitioner.

1 Minds of first and second daughters as minors

1. Petitioner has a confidence which petitioner is the one who has grown up minors. After separation children have required to petitioner to be together continuously and never changed the require. When she told them she will negotiate with opponent to take over them, second daughter delighted, first daughter wished same as petitioner to be together with little concerning about her grand parent and her uncle.
    The true heart of them is to be together with mother if now they live under stability with opponent or minors seem to have affection for opponent.

2. Minors didn't get attached to opponent until separation. Opponent has distance about nursing and growing minors, he seemed difficult to get along with minors mind that concluded hurt minors by opponent coldness. When petitioner got phone call made minors have fever meant they have fear for opponent.

3. Petitioner recognized about the incident which she refused to return minors to opponent in June 2012 led involving minors in the troubles between opponent which should take care of minors . Minors seemed scary and felt fear to return to opponent  from her care. Minors must be sad through the battle in front of them or saw the petitioner blamed by opponent.

4. It would be confusing situations for minors who must live with step-mother and her children.In the facebook of step-mother she uploaded the letter of first laughter which written "Thank you for making meals every time. Be kind to me from now on". It would not ordinary care paid by elementary kids.

 

2  About this court case

1. There are reasons below petitioner's wish to be a person with parental right for minors.

2. Minors hope to live together with petitioner.

3. It must not press them step-mother as parent. They should not live with step-mother without minors' wish. The opponent who made this confusing situation dose not seem to be a person who deserves parental right. Petitioner doubt remarriage itself which opponent has true affection to step-mother or only to run away from petitioner.

4. Instead of opponent who could not get along with minor's minds petitioner wants to get along with them for the future lasts long time. Minors are daughters so mother should be the best for them.

5. Petitioner thinks Contemporary status without meetings with mother erode the bond, of mother and daughters. Petitioner hopes to fill in their loneliness and cure their minds because minors might have conflicts and confusing situations among step-mother and her kids. On another front, petitioner could not insist to minors should be with opponent who hope to be with petitioner. If they wish to be with petitioner, she will pay every effort to do everything for them was petitioner's mind at inquest.

C.   Minors might have fears if minors see petitioner make the quarrel occurs again or police might come again. These fears might resolve with discussion and explains.Petitioner minds that to explain these points below which are no battle any more, about divorce and about what parental right is. Petitioner wants to explain about the parental right is the authority to live with children, when divorce opponent had the right and  with this authority has power to move police that's why the police came to us. 

 

3. Explain by Inquisitor 

 Inquisitor explained meeting arrangements is based on respect of the situation ongoing.

So it would have difficult to require both of meetings and change of parental right because it would have high risk to burden on minors requiring both of them.

Petitioner showed understandings about his explain but petitioner said that she could not make up mind between she has priority on seeing them as early as possible but on another front there is same priority on requiring taking over their authority. Then it could not be decided at the moment inquisitor arranged for petitioner will report after consulting with her lawyer.
 Petitioner declared by in writing on 5 Nov which is requiring the change of parental authority.

 

 

III.  Situations of minors
 Opponent said situations are absolutely same as attachment (Inquiry form for person with parental right).  Codicils are below.

1. Background until moving to Okinawa (Brief of opponent allegation)

1. Opponent said before separation of combatants the person who grew and nursed minors was petitioner then he recognized there was not any problem between mother and daughters. Opponent felt that until June 2012 minors enjoyed meeting with petitioner.

2. Opponent and step-mother met through a same friend around April 2011. The status was like once in a month gathered and went park among with other families. After these situations passed several times first son and second son of step-mother got closer to minors and enjoy playing balls, tags and practicing bicycles.

3. Opponent and step-mother started in relationship around April 2012, spent every all weekend sometimes slept at each house. Position of step-mother was like friend's mother then got closer slowly through playing with hair arrangements, make-ups which were impossible for opponent as man to play with. 3  Thus it occurred quarrels sometimes while sleeping stays started among children but they solved by themselves.

4. Opponent did not think about remarriage because of exists of minors and conflicts between petitioner. But minors became to say "Let's go to step-mother's sons house" at weekend then they showed affection to step-mother's family. Also minors showed faith to step-mother to consult the trouble about meeting with petitioner 4 made him think about remarriage with her.

5. As opponent told minors he wanted to marry one more time as a family with step-mother, minors returned "That's good". After that opponent asked them several times, minors started to say "it's nice if she was a mother".  At the point of remarriage opponent explained minors "she is your mother since now so talk to her and count on her as your mother."5 then opponent didn't explain about meetings with petitioner to minors.  After registration of marriage two sons of step-mother were adopted to opponent. Minors and step-mother's adoption was not considered at this period.

6. The motivation of moving was to avoid the wired situations of first son and daughter are same grade then the sudden appear of relative as sister or brother to their  elementary class. They chose Okinawa as follows like step-mother wished, beautiful nature, people's warm personality, less crimes than city, opponent set possible to work there and several time trips made them all like Okinawa.   The situations of minors might have big changes in environment but 3 of the minors go to same elementary school would be a big support instead. 

 

2  Situations of minors after moving (Brief of opponent allegation)

1.   After moving and addressed Okinawa minors seemed lonely several times. When opponent's grandparent visited during holidays on May 2013 minors cried at their return to Yokohama. But after that minors didn't show loneliness then settled, he felt.

2. Minors felt stressed for a while after transfer of school but soon got along with new friends among friendly kids. First daughter and first son of step-mother are same grade so few classmate asked them are a twin. Elder daughter said no to them, opponent heard. He didn't worry much at the time there was no question after that and seemed elder daughter felt nothing from about it but opponent thinks it needed to watch carefully in these situation.

3.   At the initial start of cohabit, minors changed their attitudes minding step-mother. With opponent only they could request like spoilt child but as step-mother appeared minors got their mouth shut up. Same as sons of step-mother to opponent. But these minds disappeared gradually then now opponent thinks they can request what they want like spoilt child. It seems minors enjoying the situations having brothers but vice versa the attention at each decreased so minors sometimes appeal to opponents. Opponent minds to listen to their talk at the time.

4. Step-mother is house wife and opponent works as self-employed at home brings the much time to spend with minors together.

 

IV. Conclusion after inquest of minors

1. Conclusion of domiciliary visit to inquest
A.  Situation of residence

1. Concreted built independent housing with upstairs is opponent residence. On first floor it has kitchen, living room, closet room, opponent's office room and step-mother's room. Second floor has Japanese room and minors and sons of step-mothers room. It led to entrance through the parking at ground floor, it found an inflatable boat with engine and a Kayak. There are a lot of fishing rods beside them. In the garden,  It has BBQ grill, table, chairs and iron bar which opponent made. It also has backyard maintained Pizza oven and shower room, planted Banana and acerola trees.

2. Four beds set at children room for minors. It was like double deckers with closet at bottom storage school bags and books toys in it. Children's room has ocean view.

3. Entrance of house, living room and children's room has decorated as Christmas. it has big Christmas tree in the living room and at the corner of each bed of minors has hand made socks bag. Garden has a big Santa Claus with electric decoration.

B.  Aspects of minors at inquest

1. When inquisitor visited, minors were doing home works with all together at the children's room at upstairs. As inquisitor and opponent waited them to finish, second son of step-mother finished his then ran and asked to opponent "score this". Second son of step-mother hovered over to opponent and requested him to hold him up. Opponent told to minors petitioner wants to see them but he didn't tell to the sons of step-mother about this case considered as it is not the time at this point.

2. After a while as inquisitor and opponents went upstairs, minors just finished their home works. Opponent told minors "How about greetings?" Each said "Hello" then listened tp  self-introduction of inquisitor. Minors and first son of step-mother brought their home works to step-mother with saying "Score this" then they circled step-mother and watched step-mother scoring them. After that second daughter joked to first daughter inquisitor is my favorite type then ran around together with joshing by first daughter and first son, opponent and step-mother watched them with laughing.

3. As inquisitor asked first daughter who decorated this children room first daughter replied to step-mother  "I did with step-mother", step mother  nodded with smile. First daughter explained the part of first daughter decorated and step-mother's as same with smile.

4. When inquisitor asked minors to guide inside the house everybody made merry then said "YES" but the opinions were not settled thus each tried to go different room. First daughter said "Let's go this way" led others followed then went to Japanese room at upstairs as first room.  There was a sewing machine. Inquisitor asked who use this each answered "Step-mother". "What step-mother makes?" asked again "Pillow case" said first daughter, "Bag for tools" second daughter said then "Hat"  first son answered.

5. At the bathroom inquisitor asked who is with you while you take baths, first daughter and first son answered "Father", then second daughter and second son nodded. At the bathroom, as second son tried so hard to get attention from inquisitor, second daughter desperately to stop him became like a tag game between them. Second son succeeded to run away from second daughter reached inquisitor then said "Second daughter wetted her pant with piss, look at that." Second daughter said "NO" strongly with holding second son of step-mother and messing around. As a mess escalated, opponent repressed them gently "Should stop now. or it would get a quarrel".

6. At the dinning table in the living room inquisitor asked them "where are your seats?" , minors  dashed to their seat then sat. As inquisitor asked them each what is the favorite food, "Noodle" said first son, "Rice roll" said second daughter, then every body watched at second son and joshed "Second son hates mushrooms and eggplants" made second son had embarrassed smile. As inquisitor asked first daughter's favorite, she returned " sliced raw squid " 

7. What do you guys do at the garden?, inquisitor asked then sons of step-mother  said with sparkling their eyes "Second daughter rides skateboard", everybody entered garden. As second daughter rides a skateboard,  second son of step-mother dashed to inquisitor, held his arm then said "hey look". Minors showed playing iron bar each by each, said and showed a born of squid,   picked the leaves of peach tree and guided to backyard then explained opponent bakes pizza there. As inquisitor asked about electric decoration second daughter explained step-mother bought it then maintained by opponent. After that they returned to upstairs went to balcony, first daughter found a leg of grasshopper, all circled first daughter then watched it.

8. Inquisitor asked to them where is your bed at the children room they pointed theirs vying with each other. At the moment minors found pillow cases of sons of step-mother were changed into Christmas ones, they said  "Oh!" then dashed and asked step-mother  "Make them for us immediately".  As inquisitor questioned them what is your wish on Christmas second son of step-mother brought him a letter. Everybody listened inquisitor read it with smile then first daughter told him with confidence "I wrote it".

9. Inquisitor moved to downstairs with opponent afterward then let opponent gather minors. Inquisitor explained procedure with attachment 2. Second daughter listened to it without agitation but first daughter's eyes are wet while listening, around  the end of explanation she dropped tears then wiped it by her arm. Inquest of the day finished after inquisitor asked them to tell him everything if minors have something to tell or worry about.

 

2. Conclusion of Inquest interview

1. Minors appeared to court with opponent. Second daughter walked near opponent, first daughter walked a little apart from him. Second daughter returned with smile to the greeting of inquisitor, first daughter returned to it but looked depressed. As they entered children's room of court, they showed interest in play box or dolls. Inquisitor told them could play with it delighted second daughter but first daughter seemed depressed anyway.  

2. Aspects of inquest interview

1. As inquisitor confirmed the purpose of interview, second daughter said "I tell everything I think. But I don't need to talk if I don't want to."  Inquisitor confirmed again with attachment 2, minors said they understand, first daughter had tears in her eyes. As opponent exited, the interview started.

2. As inquisitor asked to them "Is there anything you might think about?" , first daughter answered "I never want to see my mother" with full tears in her eyes, second daughter nodded. Inquisitor inquired the reason, first daughter said "I hate her playing music everyday", for second daughter said "All music thus left her children". Any other reason he asked, " Mother tattled about grandmother. Even injured her. Tattled about opponent's father or brother", said first daughter, then second daughter continued "Mother might do that if we met again."

3. Inquisitor asked them the situation of petitioner was all music, first daughter explained she faced PC with listening music all day or petitioner did not accompany at the bed when she woke up at mid night made her messed up. Music came to family after parent's relationship went bad, second daughter said she wished her mother washing clothes and they were alone in the room upstairs made them so lonely.

4. After parent separation, minors met petitioner sometimes, went to candy store and played with friends and petitioner, but these situations didn't make them messed up.   So inquisitor asked them what was the trigger to think as "They never want to see mother" , first daughter dropped full of tears then said "Second daughter was ambushed by mother at kindergarten then mother brought me to her place then after mother visited and brought me to her place, these led us impossible to go back home " "As we were kidnapped by mother so we wanted see dad but she didn't make it, I wanted to go home but she betrayed." sued inquisitor like hell with crying much. Inquisitor added "It was about June last year? " , she nodded, then he asked how you felt at the time, second daughter started to cry and said  "I thought I never go back to home" , added" it was so scary police came there." Inquisitor asked "Did you feel anxious?" First daughter replied "Very much. I felt anxious all the time at her place. I thought I never return to my home". "You might think as impossible to go back home made you anxious. How about mother's attitude toward you two. She treated you bad?"
   he asked then they nodded no. "She treated you two sweet" he asked then they replied nodded yes with little sign but first daughter said "But she lied. It's safe while we are here. She didn't make us see dad thus she promised". First daughter cried too much made cuff of her cloth wet too much sometimes happened she cried at the the desk.

5.   Inquisitor asked them "Mother understands your heart which feel anxious." First daughter nodded no "After dad said stop it a lot of times but she never stopped" Inquisitor asked them "How do you think what's gonna happen if you see mother now", second laughter replied with tears "She might bring us somewhere we don't know. We might not go back home"

6. Minors said that they told anxious feeling about their mother to opponent, opponent's mother and also step-mother. Inquisitor asked daughters still talk to step-mother about petitioner, first daughter nodded no. So he asked how step-mother recognized about this court, first daughter said "I can not get it that step-mother understands this or not."  Inquisitor continued "What do you think how do your step-mother thinks if she knew your mother wants to see you", first daughter replied she has no idea. So inquisitor implied "Might she get angry or mad." first daughter replied "I don't think so."

7. Inquisitor asked them "What kind of person your daddy is?" , first daughter answered "Gentle. He brings us wherever we wish to go" with delight.(__ so how bout your mother's place__)for second daughter she replied "Gentle and good at tickle tickle" with laughing.
     "So how about step-mother" inquisitor asked then first daughter said "It is fun she prepares Halloweens and Christmas stuffs". "She made bags for tools by sewing" he continued, second daughter answered "Yes but if it's impossible dad make it" then she recognized these words brought awe to inquisitor she continued "He cooks too" with smile. 
    About First son of step-mother, second daughter said "He is chicken. He afraid to go to toilette alone" then first daughter followed "But he is kind at passing over toys I want". 
    About second son of step-mother, second daughter said "He can go to toilette by himself but sometimes he cannot". He replied " What do they do when they cannot go toilette?" . Second daughter answered "I accompany them" with confidence.

8. As inquisitor asked them is there any problem in their current life then first daughter answered "Second son of step-mother needs to breakfast faster because he eats so slowly sometimes let us being delay to school" but nothing for others, she added. So inquisitor asked how about fun things. "It's nice to play with 4 of us, like playing games" "It's fun to be invited to decorate house （by step-mother）." she replied.
    Is there any troubles or disgusting things after living together with step-mother and her children, inquisitor asked then they replied there is nothing particular. So inquisitor added to confirm "I think it is might be a hard work to live together with someone new" ,first daughter replied "We had been together all weekend until then so nothing had changed so much."  Inquisitor asked sons of step-mother know about this court trial "No they don't . if asked something about this trial but I think they have no idea." replied by first daughter.
   About school life, first daughter enjoyed previous school before moving but present elementary school has long break time makes her please more, she said. She plays jumping rope while break time, first daughter could play cross jump with it then second daughter could play with one foot jump and backward jump with it delightedly.

9. As inquisitor asked them "How was your mother while you were living together with her.", first daughter answered she made a lot of bags for school. "Your mother could sew dresses, right ?" he added, first daughter delighted her face little bit then said "She brought me at bus stop of kindergarten too". "Can she cook?" he asked then she continued "Yes. It's delicious". Second daughter was wondering angled her head while this conversations then said "I don't remember so much." So inquisitor told her "You read picture books wit your mother, I've heard ."  She replied "I remember that" with smile. 

10. As inquisitor explained them "Mother had tenderness on some part while living together then it was fun to meet after separation though but after many things happened on June last year made you two anxious like if we might not go back home or she might bring you two to somewhere. So you two think as you never want to see your mother again." , first daughter started to cry again. "Mother understands that you two have anxious." he added then first daughter replied "Mama won't understand." then tears dropped. so he asked "Is there any way to make her understand?", she chucked her mouth with confusing.
     Is there any wish against combatants, first daughter said with tearing "I don't want her  come to us to do nasty things. I don't want her say want see us.". Inquisitor said "Anxious you might have. First of all let's make mother understands with your minds." then explain added "If you live separately now but mother is very important for you. So let's make your mother and father understand your minds of anxious which is never want to see mother again, then make a situation which dose not make you two anxious. Let them think about it telling your minds".

 

 

 

V.  Comments of Inquisitor

1. Minors spend time freely and I didn't see any particular withering in minors among the relationship with step-mother and stepbrothers. At the interview they didn't make any negative statements in current life then it recognized they enjoy their life. Before cohabit they spent together with playing and sleeping experienced, and after moving it considered there is effect that opponent and step-mother both have affluent time to communicate with children.
    On another front, minors recognized they don't get how step-mother thinks about relationship with petitioner or the point which there is not any explain on stepbrother would be agenda needed to deal with if meeting has executed.

2. Minors reported the anxiety that they might not go back home or bring them somewhere at meeting with petitioner. It considered because petitioner didn't bring minors back home times in a row led another trouble occurred the battle between combatants involving their relatives also are the reason of strong anxiety minors have.
    Considered both of combatants recognized these points which petitioner was the person who grew and nursed minors mainly before separation, there was no problem on mother and daughters and minors marked they did not hate meeting after separation. The report of minors which they never want to see petitioner again might be based big part on the reason of anxiety described above, not the problem of mother and children.
     The complaints minors reported petitioner was all music then didn't care them enough might be the minds showed minors needed to be cared by petitioner more then these bring recognition of petitioner might be important for minors. On another front, it never relates to deny opponent living together with minors if the petitioner is important much to them. It considered for minors to be hurt or given enormous anxiety caused by the battle about parental authority in front of minors or the situation police was called.
    It considered the rejection feeling on petitioner by minors has big effect on the situation which the trigger involving minors to the battle was made by petitioner or minors feel petitioner dose not understand their anxiety.

3. Considered these situations it needed both combatants correspond to remove their anxiety and fear to execute meeting go smoothly based on mother and children relationship which used to be a good one from the view on minors profit.
     Concretely speaking, petitioner should explain to minors that petitioner wished minors live delightedly under opponent and petitioner thinks to make a opportunity to see minors who live under opponent, then petitioner must apologize  sincerely to minors which petitioner had made minors anxious very much in the past. Premised petitioner corresponding opponent needs to explain to minors that they can come back home if the meeting has come to make them feel secure. And then opponent make step-mother understands meetings among them also for stepbrothers to be explained adequately.

4. But corresponding described above stands at the premise which combatants accept the situations opponent who has parental right takes actual care of minors. It must be difficult to take correspond of meeting if petitioner requires change of parental right once shown in the inquest interview on petitioner. Considered first daughter has strong anxious with tearing all the time during the interview, it should has priority to build on common sense between both of combatants about parenting to make a base to resolve their anxiety, then next it should inquest about meeting arrangement includes indirect communications like letter and gift to minors.

5. It is obvious the situation is not right for minors which has no communication between mother and children or minors has strong anxiety to their real mother. It must be confirmed how both of combatants take correspond in the situation next court date.
